Hey everybody, this is Noidance Podcast coming to you on a Sunday, July 19th, about 10 a.m. in the morning. Uh, we've got a few topics for you guys. Uh, we're gonna be hitting on ICE enforcement. We're gonna also dig into the World Cup, but uh, I thought we would, you know, kind of begin with breaking news, as we always do, and that's that two service members were killed, one missing following Iranian strikes in Jordan. Uh, this is just an escalation of the war in Iran, and there seems to be no end in sight. Uh, I there's a um audio recording that was out there about uh and I encourage you guys to go and listen to it. Basically, the Iranian guard is saying, you know, we don't take our orders from Trump, basically. And it's colorful language in there, but you know, it was about the straight of the straight of Hamoose, and you know, they're the ones, it's their country, you know, this is their strait. And you know, Trump said, you know, United States is taking over it. So it's just an exhalation tax. I don't know where the ends in sight. This is gonna be a prolonged war that I think we're just we're getting brought into, and then these service members dying isn't isn't helping anything because now you have now Trump has fodder to continue because now you know we spilt blood. But I just wanted to begin on that. Ricky, what are your thoughts?

Yeah, so the last time the Americans died were about the beginning of the war. I want to say, like in uh it's either March or maybe early April, where Iran attacked, I think it was like Kuwait, uh, Saudi Arabia. They attacked a couple of their neighboring countries, and there were American bases that they attacked specifically, and Americans were dying there. And then here it's Jordan. I don't know, I don't think they published where exactly, but it seems that you know the peace negotiations or like the ceasefire, whatever you want to call it, that was in place, you know, we've been seeing it kind of deteriorate. Uh it went from, yeah, we got it all figured out, uh, and then it went to, well, now the strait is closed, and then now the strait is open, but Americans are the ones that are going to uh guarantee safe passage. And then it was Iranians shooting, um not shooting, but uh attacking um American vessels. And so, and then yeah, now we got the you know, killing of American service members. So it's very much it's just escalating again, and like we talked about it like a couple episodes ago, like it's just however long that ceasefire was gonna last, it was never a peace deal, you know, it was never uh an end to the war, and it was always gonna be, at least in my perspective, it was always gonna be just like a kangaroo, just up and down, up and down.

Right, and you know, who knows where to end inside a whole bit sooner as opposed to later, but that's all right, guys. Our main topic today is ice, and the reason why we want to go on to because ice recently had a recent surge of tactics where they went back and arrested a bunch of people, and of course, when they do that, loss of life is always a possibility, and loss of life did happen. There was a uh a father who got killed, and there's some disputed reports if there was cocaine in the vehicle or not, but it was funny how that came out, you know, a lot a long time later, not beginning, and it just makes you you know question the credibility of that. But it I think it turned out to be like um powder for like Gatorade or something, something like that. So, you know, these things happen. But one of the things we wanted to do here on the episode today was you know, understand your rights and when if you were pulled over by ice or if you get ice show up at your door. So I'm just reading from the immigrantjustice.org. Uh it says, defend your rights. All persons in the United States have constitutional protections, including the right to remain silent when questioned or arrested by immigration officers. Being stopped by immigration officers or other law enforcement can be frightening, but it's important to stay calm during any encounter with law enforcement. It's important to do the following. Stay calm and don't run, argue, resist, or fight the officer, even if you believe your rights are being violated or you are being targeted or treated unfairly. Keep your hands where police can see them and tell them if you need to reach into a glove department or for a while to show your papers. Don't lie about your status or provide false documents. If you are pulled over in a traffic stop, ask if the officer is from the police department or immigration. Immigration officers often identify themselves as police, but they are not police. Ask if they are from immigration and customs enforcement or customs and border protection. If they are immigration officers, follow these guidelines about what information to provide. If you are a U.S. citizen or have lawful immigration status, show your passport, legal permanent resident card, work form work permit, or other documentation of your status. If you are over the age of 18, you should carry your papers with you at all times. If you are undocumented, you have the right to remain silent and do not have to discuss your immigration or citizenship status with the police, immigration agents, or other officials. Anything you tell an officer can later be used against you in immigration court. If an officer knocks on your door, do not open the door, teach your children not to open the door. Officers must have a warrant signed by a judge to enter your home. ICE warrants are not signed by judges. They are ICE forms signed by ICE officers, and they do not grant authority to enter a home without consent of the occupants. If you are outdoors and think you see immigration officers nearby, move to a safe indoor space. If you are a U.S. citizen and feel safe to do so, record the activity with your phone or write down any relevant information about what you witness. Always be careful not to interfere or otherwise obstruct the operation. Do not post unverified information on social media. Do not interfere with the investigation or otherwise put yourself in harm's way. Now, this is a good point. This is a to point out. If ICE comes to your home, the most critical step is to determine whether they have an administrative warrant or a valid judicial search warrant or an arrest warrant signed by a judge. ICE agents cannot enter private spaces without consent unless they possess a court-issued judicial warrant. A judicial warrant is a sign by a neutral judge or magistrate and grants immigration and customs enforcement legal authority to enter private property, such as a home. An administrative warrant is signed by an ICE officer or GHS official, not a judge, and does not authorize forced entry into private areas. So that's just an overview of your rights and things to look out for and some tips and traits. So, Ricky, kind of what are your thoughts?

So, two two key points here. A lot, and I guess the most of it will depend on where you're at. Either you're on the street in a vehicle, you're on the sidewalk walking, or you are in your home. Um, the constitution protects people, um, but the way your protections are afforded to you come in the form of where you're at. They're called constant constitutionally protected areas. It's a very common thing in con law uh and in criminal procedure. So your house has the most protections, right? Like that is the safe haven, that is the you know, your safe place um because of just the American history that we have. Um, and so that's why ICE agents, police officers, everybody needs a warrant to search. All that goes out the window if you fucking let them, right? And then, you know, a police officer or an ICE agent may say, Well, he let me because he opened the door, he left the door open. So I kind of walked in and he invited me in by leaving the door open. You see what I'm saying? Like it gets fucky. And even though you didn't intend to do that, the police officer thought you did. He knows he didn't, but he's gonna say he did. And so it's important that if you do talk to them and you do step out, close the door behind you, and don't, you know, just say, hey, you know, and just whatever they want to talk to you about. Um, because you know, if they have a piece of paper that says, like, hey, I have this warrant, okay. Well, I'm not gonna let you come into my home to examine this warrant, I'm gonna step out and then I'm gonna close the door behind me, and then I'm gonna look at this warrant. Is it signed by a judge or is it an administrative warrant? Um, now if you're on your if you're in your car, a lot of Americans don't know this, and I include myself in this. I thought you had a lot of protections in your car. You don't, because I used to be told that the car is an extension of your of your house. Um, and maybe that's the case for protecting it from a third person person like trying to steal something or something like that. It's not the case for our police officers. They can pull you over, you know, they can wait, you know, pull you over for whatever reason. Um, but then it's game on. They can, you know, ask for your license, they can ask you to step out of the vehicle without you doing anything. Um, I think we've talked about this before. You know, when a when a person gets asked, hey, I need you to step out of the vehicle, oh, I'm not stepping out of shit. Okay, well, then now you're obstructing, which is an additional charge. Um, the reason why police officers are allowed to do that to say, hey, I need you to step out of the vehicle is because for their safety. That's what they say. And that's what the that's what the current law is now. And that's the country, that's not state law, that's the constitution. Um, and then they're gonna be allowed to search you, right? They're gonna be, and this is all before they think you did anything. This is just, hey, I'm pulling you over because you have faulty brake light. I need to make sure you don't have any guns on you. Step out of the vehicle, let me search you. Um, now they're allowed to search your vehicle, they're not allowed to search in-depth without a warrant. So they can't search your trunk, they can't like look, you know, in the hood, they can't like you know, do too much shit without a warrant. Because what they're doing there is um, it's like it's called like um it's called a terry stop or a terry frisk, which is uh it's named after this case a long time ago. Um, but basically it's saying, like, look, I don't want I want to make sure before this interaction continues that this guy's not gonna stab me. And in order to do that, I gotta make sure he doesn't have anything on gonna search him. And when it comes to cars, it's like, well, he could have reached for something, so I gotta make sure the car is safe. Now, a lot of times that doesn't happen, but I'm saying that because if you're ever in a car and that happens, it's not an escalation. It is an escalation, but it's not like don't be don't immediately take the stand of like, hey, like, don't don't let that be the hill to die on because that's within their right, and you're gonna lose that battle 10 times out of 10 in the court of law. The other thing I wanted to say is if you're in the sidewalk, that's when your uh speaking rights, that's when your Fifth Amendment right comes into play. You don't have to say anything. Um now I'm I'm a realist. Um, I know I would rather make the altercation go away as opposed to escalate it and get arrested. Um I have my license on me, and so like let's say a person, an ICE agent or a police officer asks for my license. I'm just gonna be like, Yeah, sure, man, here's my license, fucking run it, leave me the fuck alone. He could, and we've had reports of people saying, Well, I don't believe this. I don't believe this this license is correct. I think it's fake. So I'm gonna go ahead and arrest you. Okay, well, then you're gonna arrest me anyway, even if I didn't give you my license. So, like, that's gonna happen. Um, the running thing, don't run. The reason why that's important is because running is seen as a guilt of the a state of a guilty mind in the police officers, and it's good, it's still good law now where they can say this guy's running, he must be hiding something, I'm gonna arrest him. And so you will be arrested if you do that. Um, if you're gonna videotape it, the don't stand too close. It's up, it's up to the police officer's discretion as to what is too close. There is a couple different cases that I had to read in school that said, you know, up on the sidewalk across the street was too close, which I think is bullshit. Um, but that was too close for this particular case. And it's there is no hard and fast 15 feet, 20 feet. There may be policies in certain uh locations, but there is no hard and fast rule of as to what is too close. Whatever the police officer in that moment feels like is too close, that's too close. And so if you're gonna push back and say, no, I have a right to record, you absolutely do, man. But if you stand too close, some shit's gonna go down, and you have to understand that it's gonna be the the law looks favorably on that in terms of uh favoring the police officer. So just understand that. Uh, and the last thing I'll say is that the sidewalk, the street, that is not the place to litigate your matters. That is not the place to hold court and say you are wrong, police officer. The law says this walk away fucking alive. Okay, that's the first thing. You no one can divin your rights, no one can get you any kind of remedies if you're fucking dead. Um, so that's that's the thing. Don't try to make it uh don't don't let it be a hill to die on, you know, survive, and then we'll take it up in court next day to a couple days from now, and it's gonna suck, but that at least you'd be alive. So that's all I gotta say about those specific things.

And Ricky makes a good point on that last part because at the end of the day, they have almost in almost blanket immunity. If something were to go south and they were to shoot you, they could say, Oh, he was moving, he was reaching, you know, oh, you know, back to blue campaign, that's a real thing. Or, you know, sometimes these you know bad actors are let off the hook. So you want to have your day in court. You uh just keep check your ego out the door because you're already in a vulnerable position, and you let the lawyers do their job and record, you know, do that. I think that's important, and just survive and so that your lawyer can take them to court and you can possibly win a lot of money. Who knows where that's gonna be, and just keep calm. And I know it can these these moments are very high, high strung, and you're very on alert, and it's really hard because your blood's boiling and your heart's racing, but just take a deep breath and keep calm. Now, there's these things called red cards, you can buy them online. We'll think we'll include a link in the description. But uh these say, I do not wish to answer any questions. I am exercising my Fifth Amendment right to remain silent. I do not consent to any searches under my Fourth Amendment rights, I am invoking my Sixth Amendment right to speak to a lawyer. Am I being detained or am I free to leave? Do not sign anything without speaking to an attorney, stay calm and respectful, do not lie, do not provide false documents, do not physically resist. You can purchase these uh and you can also print them out and download them on your computer at home. Just Google them. But uh, these are maybe some, these are good to give out to your friends and families or neighbors who you feel like could benefit from this card and just read from the card, stick to the script, so to speak. You don't want to go deviate from the script because you know this is important that we understand our rights as Americans and we exercise those rights. With that being said, guys, our next topic, our last topic is the World Cup. Uh, Ricky and I, we went over it. We we betted 50 American dollars. It's gonna be at two o'clock today. Uh I think Ricky, we agreed on Argentina. I said Argentina, I think you said Spain. Uh currently, you know, there's gonna be somebody going back to back and winning. This is Messi's, could be Messi's final World Cup. And that's funny because I saw a photo of one of the players when Messi was a lot younger, and one of the the players he's playing against was like a baby, and now he's playing against them in the World Cup final. And I was watching uh Fanatics when Tom Brady was asking that question. It was pretty in a pretty funny question. But on that, but uh I'm excited. I I I'm feeling pretty confident in Argentina uh because you know you have Messi, you have the storyline, you have all that behind you. And I'm feeling pretty good. Um, Ricky, kind of what are your thoughts on the cup and Spain making it? And what are you what are your odds?

So I wanted Spain, you know, I think I said it before. It's like America was my first one. I knew that was a pipe dream. Uh Mexico was number two. I you know, kind of an outside dark horse kind of thing. Uh, but then Spain, right? That was my my those my top three that I wanted to win. And I always kind of thought Spain was gonna make it far. Not surprising that they're in the final, they're a really good team. Um, but with that being said, they have more to prove than than Argentina. And because of that, I think it's gonna fuck Spain over because they're gonna be more nervous than Argentina. Argentina's like, dude, we're we won already, like, we're fine. Like, we go there, we lose, okay. We go there, we win. Outstanding. That that cool calmness, I think, is gonna be what sets them apart. Because when you see any sports, you know, for example, the NBA finals, right? We were watching a couple months ago. Uh, you could tell when the when the players were nervous, you know. Uh Wimby was, you know, missing a couple final, uh, a couple free throws down the stretch, uh, you know, free throws, things like that. Where the Knicks were just happy to be there. You know, they were just like, well, fuck, dude, like there's really not a lot of pressure on us. Like, yeah, sure, there's pressure, but like we were never supposed to make it this far, kind of thing. So I think that pressure and that cool calmness is gonna take is gonna be what separates Argentina. Now, is it gonna be enough to overcome uh the talent gap? Who knows? Right? Messi is still Messi, he's still the GOAT. Um, you know, he had a fucking hat trick in one of the first games of the, you know, of the World Cup. That's three goals in a game, um, which just doesn't happen, especially at his age. Um, and so yeah, I don't think Messi has that like you know, that monkey on his back, so to speak. He doesn't have anything left to prove. He's just out there for love of the game. Whereas Laminha Mall, who's like the best player on Spain, he's like one of their uh forwards, like a striker. Um, he's the one that's gonna be shooting a lot of shots. He is gonna be nervous. He's young, he's fucking like 19 or some shit. Like he's a fucking child. Um, he's gonna be nervous, and that's at that level, it's probably gonna affect him a little bit. So again, that's at like I think it's a I think it's three Eastern and two for y'all. Um, yeah, it's it's on Telemundo if you have Peacock, so you have to watch it in Spanish. Um, which is like as I was watching, I was like, motherfucker, I don't know what's going on.

Uh you bet $150 to win $100 to win $150. So I mean, uh $150 to win $100. That's what I'm saying. So negative is always the favorite. Positive. So, you know, if I bet $100, I get a $130. So you guys are underdogs. You guys, no, I'm I'm underdog. You you guys are favorite, so I'm just reading that. That does that make me, you know, feel a certain type of way. Uh no, because Argentina has messy, and my daughter loves Messi, and she got us a messy jersey. We've been talking about it. She she even wanted to watch the uh the game yesterday for third place. Was it uh I think it was England.

So she so she watched him, and so today we're gonna have it here at the house. My mom's gonna come over, and we're gonna probably I'm probably gonna because it's gonna be inside, not gonna be outside. I'm just gonna probably order some pizzas or something.

But speaking of that, I had some troubles with my pool. I had to drain it because I had uh a couple of tears at the bottom, and it happened because it went over to the side of my flower garden. And in my flower garden, I have these metal stakes that I didn't account for, that it kind of just butted up against it a little bit, but it was just enough where the weight of the pool pushed against the metal stake and it created a little tear. So I'm gonna patch those up, but before I patch them up, I'm gonna move it over like a few feet to my side so that doesn't happen again. And then I'm gonna patch it up. And there's also on the bottom of the pool, you I noticed there's some like spots, hard spots, where I don't know how I missed that to begin with, but I'm gonna clean that up so I don't have any hard spots on the pool because that's just another another tear waiting to happen. But uh, so it's just sand. So uh I missed I missed one of these spots, so I'm gonna fix that up and I'm gonna get the pool going again so the kids can get back in the pool. But uh Ricky, I know you had uh wanted to talk about a little something else.

Well, before we get there, because how did how are you gonna are you gonna drain it or are you just gonna try to like maneuver it with the water in there?

No, I can't maneuver with the water in there just because it's too heavy. I tried I because I could have fixed it technically with the waters, but how much it buttoned up against it was too heavy.

Yeah, so you're gonna drain it. How are you gonna drain it? Like, how does what's that process? Like a pump?

So, no, there's actually a little uh spout at the bottom of the pool that is opening, and I've already drained it, and it's all drained. It took all night. And I fucking better so yeah, my dude, my line looks gorgeous, man. I was gonna put that on. My line is freaking gorgeous. So much like freaking birds are starting to come down, and I'm like, man, I'm talking to Emily because Emily has a bird feeder with a camera, and I guess they're moving out of their house. So I was like, Emily, what are you gonna do with that? Are you gonna keep it or still? Because I don't know if they're going to apartments. She's like, dude, it's yeah, so I'm like, yes. So I'm gonna be looking at the looking at putting up a bird feeder for the birds because I didn't know I had that many birds here, and the the yard looks gorgeous, lush green. So I'm gonna push a little further, I'm gonna push like three feet over towards me so that there's no more button across against the fence or any chance of it getting a tear again. And uh I'm gonna clean out the bottom of the sand before so I make sure before I fill it up again, so there's nothing on there. I'm gonna do a fine-tooth comb. Yeah, because I'm not gonna move it again. This is gonna be it, and then I'll fill it back up and that'll be the all right.

So, yeah, so the so the last time we were gonna see is uh me, me, and you have both seen the Odyssey. Uh, we are both fans of like ancient literature, I think. Uh, not crazy fans. Like, I'm not like an exact, like I don't have all the knowledge, but I love it. I'm a good fan. I'm I'm like a fan of it, right? Like I like seeing them hearing them. So uh what are what were your thoughts on the Odyssey? Did it live up to the hype?

It did live up to the hype. I lived into the hype and did some. Here's the thing about these these movies. Everybody has an opinion. There's no right or wrong answer. You know, shades are gray. And for me, it was amazing, it was great. I love this, you know, movie shot in the imax film role. It's huge. It gives that you know thematic, that cinematic experience after movies. I I love the the people who were chosen, I love the acting. Uh I Love the how they portrayed the sirens, how they portrayed the the giants, uh the dog. And if you've read the Odyssey before, you know kind of pretty much the whole story. But just to see that in real life, I thought it was pretty good, like the the the Trojan horse that we all we know about, and see how they did the Trojan horse and how they're inside this horse, and there's water and they're coming up, and I know that that's an actor, like that's real. And and I was listening to an interview with John Berth, uh the Punisher guy, John, one of the actors in the movie. And he was all I think. Yeah, yeah. And uh he was like not trying to break, and he said, I'm not gonna break because though that water's cold and it's rushing up, and you're like in there stuck with all the other actors. So uh I loved it, I thought it was great. It you know, it took me back and it got it kept me engaged, and just to kind of let your mind go. Like kind of like when you're reading a book, you know, you you go in a different world in a different space. I kind of felt that, and it and it was just a good story, and it was a good, and I recommend you guys go watch it. It's Reddit R, but it's a good story, it's a really good story, and then I think the best part is probably at the end when Odysseus finally makes it home. So I highly recommend it's a good summer movie. You should go watch it.

Yeah, same man. You know, my favorite, and I told you my favorite part, I'm not gonna ruin it, but my favorite part uh was the uh the Cyclops part. Um, for whatever reason, I think it's because I watched the older one from like the 90s or something, and uh it was it was like in there and I it just stuck out to me. And so it was just one of those things, but I I did not that's the only part of the of the Odyssey that like stuck out to me from like knowing about it, but then I completely forgot about the sirens, like I just forgot. So when the siren scenes came up, I was like, Oh shit, that's right. I wonder if they're gonna do it the way the book or the way the story actually is, and they did, and I was like, holy crap, you know. Um, and then like just so much in there, and of course, because the story is so massive, some not everything makes it in, right? Because like there's just so many little things in there. I was concerned that uh Nolan was gonna take a more like realistic approach and like um you know, kind of not rely on like, for example, this again, I go back to the cyclops scene because that's like my favorite fucking scene, but I was worried he was gonna have like an actor who like lost his eye and then like tricks the um soldiers and then like kills them that way. I was worried that that was what it was gonna be like, like kind of like a metaphorical cyclops. That's what I was like, ah shit, that's what's gonna be, but it wasn't. Um, and so that made me happy. And so like it very much had like the magicness of like the story. There was no bullshit, there was no like, oh, this is supposed to resemble death. Like, no, no, like this was magic. And so, like, that's what I like because I know in Oppenheimer he was like, I'm not gonna use CGI, but he did not take that approach here. Uh, and it was like you said, the depictions and all that was great. And my favorite part was when he strung the boat, you know, the the ending at the very end, the bow scene, which you know that's just amazing. So, yeah, great movie.

What drew me from the poster movie posters was Agamemnon's, yeah, cussed off. It was like black Spartan. It was like, man, this is nice. That's the gold on the back of the helmet.
